I've just started a build with all the changes made this morning. I'll look at this after that completes in about 4 hours. I'll try installing over the old flex in chroot and then the grub build.

The flex-2.5.35-gcc44-1.patch is no longer needed.
The two errors in the test suite are due to changes in bison:

We can either create a patch or just mention the issues in the text.
The GRUB problem can be fixed with adding --disable-werror to GRUB's configure.

No 2.5.37. Note that 2.5.36 appears to break the build of GRUB2 and the NEWS for 2.5.37 doesn't mention anything pertinent to that. It may be a bug in GRUB2 but I've not investigated yet.
